Dealing includes manufacturing, financing the manufacturing, delivering or financing the delivering of marijuana. It is also dealing if you possess marijuana and have the intent to do any of the things that constitutes dealing. Initially, dealing marijuana is a class A misdemeanor, which is punishable with 0 to 365 days in jail.
However, dealing can be more serious if there are additional factors that increase the possible penalty. If the amount of marijuana that is found is between 30 grams and 10 pounds then the charge is elevated to a level 6 felony. In Indiana a level 6 felony carries the possible penalty of 6 months to 2 and ½ years in prison.
The penalty can then become a level 5 felony if the amount of marijuana is at least 10 pounds or more. Additionally, if you have a prior conviction for dealing and you get arrested again it is a level 5 felony for between 30 grams and 10 pounds. A level 5 felony is punishable with between 1 and 6 years in prison.
Dealing in marijuana can also lead to making someone a habitual substance offender after multiple convictions which can cause even more harsher penalties added on to their sentence. The crime of Dealing in Marijuana is still frequently prosecuted in Indiana despite it being legal in many of the surrounding states.
